Intimate Occasions Luxury Picnics Standard Contract

Thank you for choosing Intimate Occasions.  Please be sure to look over our contact and policies to ensure you have the best experience. Please be advised that once services are booked and secured with payment; you agree to the terms of the contract listed below.

PAYMENTS: Upon reading and agreeing to this contract, you agree to pay a retainer fee to secure your picnic date and time for two (2) hours. Please note that 50% of your balance is due at the time of your booking. This retainer fee is required at the time of booking. Please be advised that a retainer is a fee that is paid in advance to hold a service. A retainer is by default non-refundable and is not returned. Events scheduled less than one week before scheduled date requires full balance paid during booking. You will have the choice to pay the entire balance during the time of booking. Keep in mind that we do not book the event until the package is paid in full. In addition, we do not accept payments onsite due to our policy. All balances are due 3 days prior to the event and no services are rendered until paid in full. 

Any additional hour is $50 per hour up to a maximum of four (4) hours total. Should you require an event longer than four (4) hours, please let us know. A non-refundable deposit for all guests and hours is required at the time of the booking.

LATE POLICY: We strive on time management for many of reasons. if you are late more than 20 minutes for your picnic reservation it will be cancelled and you would have to reschedule for another day, No exceptions. There are many of picnics in one day and that can set back other picnic reservations. I cannot leave picnics unattended until you arrive, picnic reservation is not an open slot to show up anytime within 2 hours. You shorten your time when you’re late. If your event is scheduled for a specific time (Ex: 2:00pm -4:00pm), please note that we are still scheduled to take down at our scheduled time regardless of the time you showed up. Being late does not extend your time slot. 

ADDITIONAL GUEST: There is a $25 fee for every additional guest. If additional guests attend and are not paid for upfront, please note that you will be charged post picnic. NON-PAID guests will result in immediate termination of future services. 

INFLUENCERS/BRAND AMBASSADOR: An influencer contract is the agreement between an influencer and the brand who wants to collaborate with this content creator. The agreement governs the terms of the collaboration, including the content or product to be created, compensation will be an exchange of products and service for promotion, and legal protection for all parties. The term of this Agreement shall commence on the effective date of this Agreement. The date being appointment confirmation date. During which time the Influencer will create Instagram content; both creating a post and tagging Intimate Occasions Luxury Picnics and also including us on your story, create a Facebook post, and create a TikTok video on their experience with Intimate Occasions Luxury Picnics LLC. The content shall clearly identify the Brand by stating its name and tagging its official social media platforms. The Influencer may choose which day on which in a 5-day window to post the content. The Influencer is free to publish any additional content featuring the Brand and its products – with respect to the Brand’s intellectual property. 

CANCELLATION, REFUND, & DAMAGES POLICY: Intimate Occasions Luxury Picnics LLC. does not offer refunds for any picnics once payment has been received. If you would like to cancel a picnic because of the weather or any other reason such as COVID, that is no problem. We ask that you give us at least 72-hour notice if possible. We understand personal circumstances may change so we allow clients to reschedule a booking in the event of a cancellation. Clients who cancel their scheduled appointment less than 24 hours before their scheduled appointment will not have the option to reschedule. Clients who choose to reschedule their event must do so within 45 days of original picnic date. Again, Retainer fees are non-refundable. If the client chooses to cancel, they forfeit all money paid.

NO EXCEPTIONS!
All reservations are weather permitting. In the event of rain in the forecast, we will do all we can to accommodate a dry picnic either by moving the location or by rescheduling you to another day and time. Please reach out to us at least 24hrs before your scheduled picnic if you wish to reschedule due to inclement weather.
Should any items used during your picnic experience provided by Intimate Occasions Luxury Picnics LLC. be damaged, We reserve the right to collect charges associated with damage or extra cleaning. You will be sent an invoice for damaged items and expected to pay said invoice within five (5) business days from the invoice date.

PROPERTY DAMAGE: I agree that in the event that any damage to equipment or facilities occurs because of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
I agree to leave the premise, and all items located thereon, in as good order and condition as they were immediately prior to my use of the premises, and to pay for any damage plus any additional fees that may occur to the premises by me, and/or invitees. 

PHOTOGRAPHY /SOCIAL MEDIA: Intimate Occasions Luxury Picnics LLC. reserves the right to use photographs of your event/picnic to share either on social media. Intimate Occasions Luxury Picnics LLC. reserves the right to use such photographs in its promotional materials. I understand that no royalty, fee, or other compensation shall become payable to me or anyone in my party by reason of such use.

PICNIC SETUP: Intimate Occasions Luxury Picnics LLC. reserves the right to modify any picnic décor based on factors such as availability, décor conditions, damages, etc. We take every care to ensure that the description and specification of our picnic displays are accurately represented based on our website and social media accounts, however, specifications and descriptions of products on these sites are not intended to be binding and are intended only to give a general description of the products.

CODE OF CONDUCT: By purchasing a picnic experience or any event held by Intimate Occasions Luxury Picnics LLC., you agree that you and your guest will conduct yourselves in an appropriate manner throughout the course of your participation. You agree that you will not engage in activity or behavior that:
1. violates the rules or codes of conduct of the location, including excessive intoxication or consumption of alcoholic beverages when consumption of alcoholic beverages is expressly forbidden;
2. advertises or offers to sell any products, services or otherwise (whether or not for profit), or solicits others (including solicitations for contributions or donations).
3. is illegal or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them, including drug dealing and/or drug abuse, harassment, theft, or conspiracy to commit any criminal activity; and
4. (a) is untrue, inaccurate, defamatory, abusive, harassing, threatening, or an invasion of a right of privacy of another person; (b) is bigoted, hateful, or racially or otherwise offensive; (c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms or can reasonably be expected to harm any person or entity;
We cannot and do not assure that other participants or other visitors of your location are or will be complying with the foregoing Code of Conduct or any other provisions of these Terms and Conditions, and, as between you and us, you hereby assume all risk of harm or injury resulting from any such lack of compliance.

COVID-19 PRECAUTIONS: Intimate Occasions Luxury Picnics LLC. places your health and safety as our top priority. Here are the steps we’re taking to help everyone feel safe:
All tables, chairs, and containers are disinfected after each picnic and all rugs, linen napkins, and dishes are washed before and after each experience as well (as will always be our policy).
We will continue social-distancing efforts when setting picnics up in public areas, even if it is not officially mandated. We cannot promise that your picnic area will be private as many of our locations are public. We make no assumptions or claims in connection with our vendors and add-ons regarding Covid 19 precautions and standards.
